These Terms & Conditions (“Terms”) govern your use of smartstackoc.com (the “Site”) and purchases from Smart Stack OC (“Smart Stack,” “we,” “us,” or “our”), 16371 Gothard St. Ste C, Huntington Beach, CA 92647. By using the Site or placing an order, you agree to these Terms.

Eligibility

You must be at least 18 years old to use the Site or purchase products.

Research use only

All products are sold strictly for research and laboratory use only. They are not drugs, foods, dietary supplements, or cosmetics and are not intended for human or animal consumption. Products are not intended to diagnose, treat, cure, or prevent any disease. Statements on the Site have not been evaluated by the FDA. By purchasing, you agree to handle products safely and lawfully and accept responsibility for their use.

Orders & payment

Prices are listed in U.S. dollars. Orders are placed online and paid by Zelle or Apple Cash using the instructions provided at checkout and in your order email. Orders are held until payment is received and may be cancelled if payment is not received within a reasonable time. We may refuse or cancel any order.

Pick-up, delivery & shipping

• Free pick-up at our Huntington Beach office once payment is received
• Local delivery ($20) within 30 miles of Huntington Beach, CA 92647
• 2-Day Shipping ($18 flat rate) and Overnight Shipping ($40 flat rate) within the United States

Delivery times are estimates and carrier delays are outside our control. Risk of loss passes to you on pick-up or delivery.

Returns

For product integrity, opened or used products cannot be returned. If your order arrives damaged or incorrect, contact us within 3 days of receipt and we will make it right.

Text messaging terms (SMS program)

Program: Smart Stack OC text messages. When you opt in through our text sign-up page or otherwise provide express consent, you agree to receive text messages from Smart Stack OC at the mobile number you provided.

• Message types: order confirmations, payment reminders, pick-up and delivery updates, and customer care replies (transactional); and, if you separately opted in, new product announcements and special offers (marketing).
• Frequency: message frequency varies based on your orders and interactions; marketing messages up to 4 per week.
• Cost: Message and data rates may apply.
• Opt out: Reply STOP to any message to unsubscribe. You will receive one final message confirming you have been unsubscribed.
• Help: Reply HELP for help, or contact us at (949) 353-6700 or info@smartstackoc.com.
• Consent to receive text messages is not a condition of purchase.
• Carriers are not liable for delayed or undelivered messages.
• Your mobile information will not be shared with third parties or affiliates for marketing or promotional purposes. See our Privacy Policy.

Limitation of liability

To the fullest extent permitted by law, Smart Stack’s total liability for any claim relating to a product or the Site is limited to the amount you paid for that product. We are not liable for indirect, incidental, or consequential damages, or for any misuse of products.

Governing law

These Terms are governed by the laws of the State of California. Any dispute will be handled in the courts located in Orange County, California.

Changes

We may update these Terms at any time. The effective date above shows when they were last updated.
